Welcome to WeekendPlant ("we," "us," or "our"), operated by Joshua Wetzel DBA WeekendPlant. By accessing or using our website at weekendplant.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.
1. Eligibility
You must be at least 13 years of age to create an account or use the interactive features of the Site. By using the Site, you represent and warrant that you meet this age requirement. If you are under 18, you may only use the Site with the involvement of a parent or guardian.
2. Account Registration
To access certain features — including submitting content, subscribing to newsletters, and managing your preferences — you may need to create an account using an email address and password.
You agree to:
- Provide accurate and complete registration information.
- Keep your login credentials secure and confidential.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account.
3. User-Submitted Content
3.1 What You May Submit
The Site may allow registered users to submit gardening tips, photos, comments, reviews, and other content (collectively, "User Content").
3.2 Ownership and License
You retain ownership of your User Content. By submitting User Content to WeekendPlant, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any medium, format, or channel now known or later developed, for any purpose, without further compensation or attribution to you.
You represent and warrant that you have the right to grant this license and that your User Content does not infringe any third party's rights.
3.3 Content Standards
You agree not to submit content that:
- Is unlawful, defamatory, obscene, threatening, or harassing.
- Infringes any patent, trademark, copyright, or other intellectual property right.
- Contains viruses, malware, or other harmful code.
- Is spam, advertising, or promotional material not authorized by us.
- Impersonates any person or entity or misrepresents your affiliation with a person or entity.
- Contains images that are not gardening-related or appropriate.
3.4 Review and Removal
All submitted content is subject to review and approval by our team before publication. We reserve the right to reject, edit, or remove any User Content at our sole discretion and without notice.
4. AI-Generated Content
WeekendPlant uses artificial intelligence to assist in creating gardening content, including but not limited to:
- Generating how-to guides, plant profiles, and garden combo plans.
- Creating and enhancing images for articles.
AI-generated content is reviewed and edited by our team before publication. However, such content is provided for informational purposes only and may contain inaccuracies. See Section 9 (Gardening Disclaimer) for important limitations.
AI Training Data: Content published on the Site may be sent to third-party AI providers (such as OpenAI) for processing. These providers may use data submitted through their APIs to improve and train their models, in accordance with their own terms and privacy policies. No personal information (such as your name, email, or account details) is sent to AI providers — only site content.
5. Copyright Infringement (DMCA)
WeekendPlant respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, you may submit a takedown request under the Digital Millennium Copyright Act (DMCA) by visiting our DMCA Takedown Request page or by sending written notice to [email protected].
Your notice must include:
- A description of the copyrighted work you claim has been infringed.
- The URL or location on the Site where the allegedly infringing material is found.
- Your name, mailing address, phone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who submitted it, if applicable. Repeat infringers may have their accounts terminated.
6. Intellectual Property
All content on the Site that is not User Content — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the overall design and arrangement of the Site — is the property of WeekendPlant or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Site content without our prior written permission.
7. Advertisements
The Site may display advertisements from third-party brands and partners. These ads may appear on browse pages, detail pages, and other areas of the Site. Advertisements are clearly distinguishable from editorial content.
We are not responsible for the products, services, or claims made in third-party advertisements. Clicking on an ad may take you to an external website governed by its own terms and privacy policy. No personal information is sold to or shared with advertisers.
8. Prohibited Conduct
When using the Site, you agree not to:
- Violate any applicable law, regulation, or these Terms.
- Use the Site for any unauthorized commercial purpose.
- Interfere with or disrupt the Site's servers or networks.
- Attempt to gain unauthorized access to any accounts, systems, or data.

9. Gardening Disclaimer
All gardening information, advice, guides, plant profiles, and recommendations on this Site are provided for general informational and educational purposes only. They are not a substitute for professional horticultural, agricultural, medical, or safety advice.
You acknowledge and agree that:
- Plant identification and toxicity: Some plants discussed on the Site may be toxic to humans, pets, or livestock. Always verify plant identity and toxicity independently before handling, consuming, or planting. We are not responsible for misidentification or adverse reactions.
- Chemical and pesticide use: Fertilizers, pesticides, herbicides, and other garden chemicals can be dangerous to humans, animals, and the environment. Some products mentioned on the Site may be restricted, banned, or require a license in your area. Always check your local, state, and federal regulations before purchasing or applying any chemical product. Always read and follow manufacturer labels, safety data sheets, and recommended protective equipment. We are not responsible for injury, illness, property damage, or environmental harm resulting from the use or misuse of any chemical products mentioned on the Site.
- Physical injury: Gardening involves physical activity and the use of tools and equipment. You assume all risk of personal injury arising from gardening activities you undertake based on information from the Site.
- Crop and plant outcomes: Results from gardening depend on climate, soil, water, geography, and many other variables. We do not guarantee any specific outcome, harvest, yield, or plant survival.
- Allergic reactions: Some plants, soils, fertilizers, or garden materials may cause allergic reactions. If you have known allergies, consult a medical professional before working with unfamiliar plants or materials.
- Edible plants and foraging: Information about edible plants is for educational purposes only. Never consume any plant unless you are 100% certain of its identity and safety. Misidentification of edible plants can result in serious illness or death.
- Local regulations: Gardening practices, water usage, plant species, and chemical applications may be subject to local, state, or federal regulations. It is your responsibility to comply with all applicable laws in your area.
You use any information from the Site entirely at your own risk.
10. Third-Party Links and Services
The Site may contain links to third-party websites or services that are not owned or controlled by WeekendPlant. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party sites at your own risk and should review their terms and policies.
11. Disclaimer of Warranties
The Site and all content, features, and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, WeekendPlant and its owner, operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, or goodwill — arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. This includes, without limitation, damages arising from reliance on gardening advice, plant identification, chemical recommendations, or any other information provided on the Site. Our total aggregate liability for any claims arising out of or related to these Terms or the Site shall not exceed fifty dollars ($50).
13. Indemnification
You agree to indemnify, defend, and hold harmless WeekendPlant, its owner, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of a third party; or (e) any injury, illness, or property damage resulting from your reliance on information provided on the Site.
14. Dispute Resolution and Arbitration
14.1 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site ("Dispute") shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the State of Louisiana, or at another mutually agreed location. The arbitrator's decision shall be final and binding.
14.2 Class Action Waiver
You agree that any Dispute will be resolved on an individual basis only. You waive your right to participate in a class action, class arbitration, or any other representative proceeding.
14.3 Exceptions
Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
15. Termination
We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
16. Modifications to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles.
18. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and WeekendPlant regarding your use of the Site.
